MUSICTODAY TICKETING USER AGREEMENT Welcome to Musictoday, Inc. ticketing (“Site”) which provides its services to you subject to the following notices, terms and conditions (“Terms”). By using the Site, you agree to be bound by these Terms and to follow these Terms and all laws and regulations governing the Site. Musictoday, Inc. has the right to change these Terms at any time, which shall be effective as to any transaction made following the posting of the change on the site. Lawful Use You may visit, view and retain copies of this Site for your own personal use but may not duplicate, download, publish, modify or otherwise distribute information from the Site for any purpose other than to review event information and to purchase tickets for personal use, unless otherwise specifically authorized by Musictoday, Inc. Musictdoay.com reserves the right to refuse service, terminate accounts, and/or cancel orders in its discretion, including, without limitation, if Musictoday, Inc. believes the customers conduct violates applicable law or is harmful to the interests of Musictoday, Inc. Copyright All content included on the Site, such as text, graphics, logos, button icons, images and software is the property of Musictoday, Inc. or its content suppliers and protected by U.S. and international copyright laws. The compilation of all content on this site is the exclusive property of Musictoday, Inc. and protected by U.S. and international copyright laws. The content and software of this site may be used as a shopping resource. Any other use, including the reproduction, modification, distribution, transmission, republication, display, or performance, of the content on this site is strictly prohibited. Musictoday, Inc. does not promise that the Site will be error-free or uninterrupted, or that it will provide specific results from use of the Site content. The Site and content are delivered on an “as-available” basis without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability or fitness for a particular purpose. Except in jurisdictions where such provisions are restricted, in no event will Musictoday, Inc. be liable to you for any indirect, consequential, exemplary, incidental special or punitive damages, including lost profits, even if Musictoday, Inc. has been advised of the possibility of damages. The disclaimer of liability applies to any and all damages or injury from any cause, including without limitation damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action. Sales and Refunds All Sales Are Final. If the event is cancelled, rescheduled, or the venue is closed for any reason, you will be updated via email as soon as information is available. We will send an e-mail to the e-mail address provided by you in the ordering process (you must provide a valid e-mail address with your order). Before traveling to the show, please confirm the show with the venue. For General Admission Tickets To Be Picked Up At Will-Call By Customer - Refunds due to cancellation or unforeseen facility closure will be issued in the amount of the face value of the tickets. In the event of cancellation or unforeseen facility closure, convenience and handling fees will not be refunded in order to cover the costs already incurred by Musictoday, Inc. For General Admission or Reserved Seating Tickets Shipped to Customer - Refunds due to cancellation or unforeseen facility closure will be issued automatically in the amount of the face value of the tickets. In the event of cancellation or unforeseen facility closure, convenience, shipping and handling fees will not be refunded in order to cover the costs already incurred by Musictoday, Inc. Tickets for sale are intended for purchase by adults. By making a purchase on the site, you agree that you are at least 13 years of age. Order Pickup and Delivery Will-call orders will be held at the venue box office. You must bring your confirmation e-mail receipt, picture ID, and credit card used to purchase the tickets online. If you are unable to pick up your tickets at the venue because you do not have the credit card you used to purchase the tickets, we are unable to offer a refund for your ticket order. Only the individual placing a will-call order may pick up the tickets ordered. Shipped orders are usually sent approximately two weeks before the first show ordered. If any shipped orders are re-routed after they have been sent, there is an additional fee. Shipped orders cannot be delivered to PO Box addresses. Entering a PO Box address may cause a delay in delivering your tickets and/or extra shipping charges. As show availability is subject to change, please check back often. Please direct any ticket concerns to tix@musictoday.com or call 1-800-594-TIXX. Phone operators are available 9am-12am Eastern Time Monday through Thursday and 9am-8pm Eastern Time on Fridays. By placing your order, you acknowledge that your name will be released to the event coordinator. Re-Selling Tickets purchased through this site are intended for personal use. We strictly prohibit the resale of any tickets obtained through this site for more than the purchase price. If you are found to be reselling, trading or brokering tickets that you purchased through this site for profit, we may at our sole discretion cancel your ticket order and all other pending orders in your name or put all orders and all other pending orders in your name at will-call for pick-up. In the event the tickets are cancelled, a refund of the total face value of the tickets minus a $7 per ticket processing fee and any shipping or processing fees that have been incurred with respect to the order will be issued to the card used to place the order. If tickets are placed at will-call, they can only be picked up by the person whose name is on the order. No will-call name changes will be allowed. We reserve the right to investigate all orders suspected to be in violation of this policy. We are the final authority on the interpretation of these rules.
